Terms of Use – Dataneb

Welcome to Dataneb (the "Site"). Please read these Terms of Use ("Agreement") carefully before accessing or using this website. By using the Site, you (“User,” “You,” or “Your”) agree to be legally bound by the terms and conditions of this Agreement, which form a binding legal contract between you and Dataneb ("Dataneb", "we", "us", or "our"). If you do not agree to these terms in full, do not access or use the Site. Use of the Site constitutes ongoing and continuous acceptance of all provisions herein.

1. Scope of Agreement and Incorporation of Policies

This Agreement governs your access to and use of the Site, its data aggregation services, predictive tools, visualizations, analytics, public records compilers, calculators, and any associated content, functionality, or services (collectively, the “Services”). This Agreement expressly incorporates by reference:

  • Our Privacy Policy

  • Our Disclaimer Statement

  • Any specific data usage notices or embedded policy disclaimers

Your use of the Site is also subject to all applicable laws and regulations, and you hereby represent and warrant that you have the full legal authority to enter into this Agreement and to be bound by its provisions.

2. No Government Affiliation

Dataneb is an independent entity and is not endorsed by, affiliated with, or officially connected to the United States Citizenship and Immigration Services (USCIS), Department of Homeland Security (DHS), or any other government agency, bureau, or department. All logos, marks, and references to government entities are made for informational and descriptive purposes only.

No claim is made as to the accuracy, official status, or completeness of government-related information displayed.

3. Informational Nature and No Legal Advice

The information, content, and tools made available on this Site are strictly intended for general educational, informational, and non-commercial purposes.

Under no circumstance should any information on Dataneb be construed as:

  • Legal advice

  • A substitute for legal representation

  • Immigration guidance or approval predictions

  • Binding or official communications from government authorities

 

Users are explicitly advised to consult with qualified immigration attorneys or accredited representatives before taking any action based on content accessed through the Site.

4. Use at Your Own Risk – No Warranties

Dataneb and all Services are provided “AS IS,” “AS AVAILABLE,” and WITHOUT WARRANTIES of any kind, either express or implied, including without limitation:

  • Warranties of non-infringement

  • Warranties concerning the timeliness, completeness, accuracy, reliability, or usability of data

 

No oral or written information given by us or our employees shall create a warranty.

5. Data Reliability, Accuracy, and Predictions

The predictive tools, visualizations, and analytics on Dataneb rely on public sources, government announcements, and algorithmic estimations based on historical data. You acknowledge that:

  • Data may be outdated or incorrect at the time of viewing

  • Predictive features do not reflect real-time USCIS processing or adjudication status

  • You are solely responsible for verifying any information before relying upon it

6. No Agency Relationship or Fiduciary Duty

Your use of the Site does not create any agency, fiduciary, employment, contractor, or joint venture relationship between you and Dataneb. No communication or interaction shall be construed as legal representation or any form of advisory relationship.

7. Indemnification

You agree to indemnify, defend, and hold harmless Dataneb and its affiliates, directors, officers, employees, agents, data partners, and licensors from and against all claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising from or in any way related to:

  • Your use or misuse of the Site

  • Your violation of any term of this Agreement

  • Your reliance on any information displayed

  • Any unauthorized access, use, or disclosure of data

This indemnification clause survives termination of your use of the Site.

8. Limitation of Liability

To the maximum extent permitted under applicable law, Dataneb, its affiliates, employees, licensors, and agents shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages including but not limited to:

  • Immigration outcomes

  • Financial losses

  • Opportunity costs

  • Reputational damage

  • Delays in benefit adjudication

  • Legal, emotional, or psychological distress

Our maximum aggregate liability, regardless of form, shall not exceed one U.S. dollar ($1.00).

9. Arbitration Agreement and Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to this Agreement shall be resolved through binding, individual arbitration administered in Orange County, California under the rules of the American Arbitration Association (AAA).

Important:

  • No class actions or mass arbitration allowed

  • You waive your right to trial by jury

  • Arbitration shall be confidential and final

  • Judgment may be entered in any court having jurisdiction

10. User Responsibilities

You agree not to:

  • Use data for commercial reselling

  • Scrape, mirror, copy, or reverse-engineer the Site

  • Attempt to bypass security or technical access restrictions

  • Use automated tools to overwhelm servers or APIs

  • Provide false information when using Site tools

 

You also agree to comply with all applicable local, state, national, and international laws and regulations when using the Site.

11. Ownership, Licensing, and Intellectual Property

All content, source code, graphics, logos, tools, and documentation on Dataneb are either owned by Dataneb or used with proper authorization and are protected under U.S. and international intellectual property laws. Unauthorized reproduction, reuse, or modification is strictly prohibited.

You are granted a limited, revocable, non-exclusive, non-transferable license to use the Site for personal, non-commercial use only.

12. Data Aggregation and Third-Party Sources

Much of the content is derived from public domain datasets, news sources, or government releases. We do not guarantee:

  • That the data is complete or current

  • That the original source maintains ongoing access

  • That our representation of the source data is error-free

We are not responsible for inaccuracies originating from third parties.

13. User-Submitted Data

Any data you submit (e.g., USCIS receipt number, form type, feedback, etc.) becomes part of our aggregated, anonymized database. You agree that:

  • Your submission does not establish a confidential relationship

  • We may store, analyze, and publish aggregate versions

  • You waive any right to compensation or royalties

14. Communications Policy

We do not provide any form of customer service, legal support, case-specific guidance, or immigration advice. You may not:

  • Demand communication or data alteration

  • Threaten legal action over content accuracy

  • Submit unsolicited proposals, media requests, or complaints

 

Contact attempts unrelated to legitimate legal notice may be ignored or reported as harassment.

15. Governing Law and Venue

This Agreement shall be governed by and interpreted in accordance with the laws of the State of California, excluding its conflict-of-law principles. You irrevocably submit to the exclusive jurisdiction and venue of the courts located in Orange County, California.

Any claim or cause of action must be filed within one (6) months of the date it arises or shall be barred permanently.

16. Force Majeure

Dataneb shall not be liable for delays or failure to perform resulting from causes beyond its reasonable control, including acts of God, power outages, pandemics, labor shortages, cyberattacks, government actions, or internet outages.

17. Severability and Waiver

If any provision of this Agreement is held invalid, the remainder shall remain in full force. Our failure to enforce any term shall not be deemed a waiver.

18. Changes to Terms

We reserve the right to update, revise, or change these Terms at any time without notice. It is your responsibility to review these Terms periodically. Continued use constitutes acceptance of modifications.

19. Entire Agreement

These Terms, along with our Privacy Policy and Disclaimers, constitute the entire agreement between you and Dataneb and supersede all prior communications, agreements, or understandings.

20. Contact and Legal Notice

Dataneb does not maintain a public support team. For legal notices only, you must send formal communications through a licensed attorney to our registered agent in California.
 

Users are explicitly prohibited from:

  • Attempting to contact the owner or contributors for legal threats

  • Sending unsolicited messages regarding content accuracy or responsibility

  • Demanding edits, removal, or changes to content without legal authority

By using Dataneb website, you also agree to the Google's Terms and Conditions, Privacy Policy and consent to the collection, use, and disclosure of your personal information as described herein.
